欢迎使用Mindora！感谢您对我们的关注。本《服务条款》（“本协议”）阐述了您使用 mindora.com（“网站”）、智能助眠硬件、充电器及/或其他相关产品，包括Mindora移动应用程序（“Mindora应用”）（统称为“服务”）所适用的条款和条件。本网站和Mindora应用由 Shanghai Genesis Technology Co., Ltd 及其关联公司和子公司（统称为“Mindora”、“我们”或“我们的”）拥有并运营。

在本协议中，我们称自己为“Mindora”、“我们”；我们称您为“您”或“用户”。Mindora和用户在本协议中单独称为“一方”，合称为“双方”。

Welcome to Mindora! Thank you for your interest. These Terms of Service ("Agreement") set forth the terms and conditions applicable to your use of mindora.com (the "Site"), smart sleep aid hardware, chargers, and/or other related products, including the Mindora mobile application (the "Mindora App") (collectively referred to as the "Services"). The Site and the Mindora App are owned and operated by Shanghai Genesis Technology Co., Ltd and its affiliates and subsidiaries (collectively, "Mindora," "we," or "us").

通过访问或使用服务（包括访问网站），即表示您有意并明确同意受本协议所有条款和条件以及《Mindora隐私政策》（详见 mindora.com/privacy-policy，通过引用并入本协议，下称“隐私政策”）的约束。如果您不同意这些条款和条件，则不得使用服务。

By accessing or using the Services, you agree to be bound by these Terms and the Mindora Privacy Policy (available at mindora.com/privacy-policy). If you do not agree, do not use the Services.

1.访问与使用许可 | Access and Use

Mindora 授予您一项有限的、可撤销的许可，允许您根据本协议访问和使用服务。您声明您已年满18周岁并有权接受本协议。您不得：（i）对服务进行反向工程、反汇编或破解；（ii）将服务用于非法目的或侵犯他人权利；（iii）干扰服务的正常运行或安全性。

Mindora grants you a limited, revocable license to access and use the Services per these Terms. You represent you are at least 18 and authorized to accept these Terms. You shall not: (i) reverse engineer, disassemble, or hack the Services; (ii) use the Services for unlawful purposes or to infringe others‘ rights; (iii) interfere with the operation or security of the Services.

2.用户责任 | Your Responsibilities

您对使用服务的行为及账户安全全权负责。您必须确保账户信息准确，并对密码保密。您同意仅将服务用于合法目的，并遵守所有适用法律。

You are solely responsible for your use of the Services and the security of your account. You must keep account information accurate and passwords confidential. You agree to use the Services only for lawful purposes and in compliance with all applicable laws.

3.硬件产品与购买 | Hardware Products & Purchases

所有硬件产品的销售均以我们网站上公布的产品信息、库存情况和单独的销售条款为准。价格如有变动，恕不另行通知。硬件产品可能附带单独的有限保修，具体条款详见产品包装或支持页面。订单的发货时间为预估时间，因供应链导致的延误我们不承担责任。

All Hardware sales are subject to product info, availability, and separate sales terms on our Site. Prices are subject to change without notice. Hardware may come with a separate limited warranty (see packaging or support page for details). Shipping times are estimates; we are not liable for supply chain delays.

4.订阅、费用与退款 | Subscriptions, Fees & Refunds

部分高级功能可能需要付费订阅。订阅期将自动续订，直至您取消。您可随时在账户设置中取消，取消将在当前计费周期结束后生效。除非法律另有规定，已支付的订阅费用不予退款。我们可能提供免费试用，您需在试用期结束前取消以避免被收费。

Certain premium features may require a paid subscription. Your subscription will auto-renew until you cancel. You may cancel anytime in your account settings, effective at the end of the current billing cycle. Payments are non-refundable unless required by law. We may offer free trials; you must cancel before the trial ends to avoid charges.

5.知识产权 | Intellectual Property

Mindora 及其许可方拥有服务所有内容、功能、设计、商标和知识产权的所有权。本协议未授予您任何上述权利。未经明确许可，您不得复制、修改或商业性利用服务的任何部分。

Mindora and its licensors own all content, features, design, trademarks, and IP in the Services. These Terms grant you no right to them. You may not copy, modify, or commercially exploit any part of the Services without explicit permission.

6.重要免责声明 | Important Disclaimer

Mindora 产品为非医疗设备。它提供的睡眠与健康数据仅供参考，不能替代专业的医疗诊断、建议或治疗。你明确同意，Mindora 不会通过服务向你提供医疗建议。这些服务不用于诊断、治疗、治愈或预防任何疾病或医疗状况。这些服务仅供参考，不能替代医生或医疗专业人员的服务。请勿仅根据本产品数据做出医疗决策。如有健康疑虑，请咨询医疗专业人士。

The Mindora product is a wellness technology device, not a medical device. The sleep and wellness data it provides is for informational purposes only and is not a substitute for professional medical diagnosis, advice, or treatment.

You expressly agree that Mindora does not provide medical advice through its services. These services are not intended to diagnose, treat, cure, or prevent any disease or medical condition. These services are for reference only and are not a replacement for the services of a physician or other healthcare professional.

Do not make medical decisions based solely on the data provided by this product. If you have any health concerns, please consult a qualified healthcare professional.

7.责任限制 | Limitation of Liability

在法律允许的最大范围内，服务按“现状”提供，Mindora 不就其准确性、可靠性作出任何明示或暗示的保证。我们不对因使用或无法使用服务导致的任何间接、附带或后果性损害负责。在任何情况下，Mindora 的累计责任不超过您就引起责任的服务所支付的费用总额。

To the fullest extent permitted by law, the Services are provided “as is” without warranties. We are not liable for any indirect, incidental, or consequential damages arising from use of the Services. In no event shall Mindora‘s total liability exceed the amount you paid for the Services giving rise to the liability.

8.赔偿 | Indemnification

如因您使用服务、违反本协议或侵犯第三方权利而引发任何索赔或诉讼，您同意为 Mindora 及其关联方进行辩护、赔偿并使其免受损害。

You agree to indemnify and hold harmless Mindora and its affiliates from any claims or lawsuits arising from your use of the Services, violation of these Terms, or infringement of third-party rights.

9.协议的修改与终止 | Modification & Termination

我们保留随时修改本协议的权利。实质性修改将通过网站或 App 通知。继续使用服务即表示接受修改后的条款。若您严重违反本协议，我们保留暂停或终止您访问服务的权利。

We reserve the right to modify these Terms at any time. Material changes will be notified via the Site or App. Your continued use constitutes acceptance. We may suspend or terminate your access if you materially breach these Terms.

10.通用条款 | General Terms

管辖法律：本协议受您居住地/公司注册地法律管辖。

Governing Law: These Terms are governed by the laws of your country/region of residence or incorporation.

争议解决：双方应首先尝试通过友好协商解决争议。

Dispute Resolution: Parties shall first attempt to resolve disputes through good-faith negotiation.

可分割性：若本协议某条款被认定为无效，不影响其余条款的效力。

Severability: If a provision is found invalid, the remaining provisions remain in effect.

完整协议：本协议与《隐私政策》构成双方关于服务的完整协议。

Entire Agreement: These Terms and the Privacy Policy constitute the entire agreement regarding the Services.
